We Stand With Dr Azmi Sharom

We, the undersigned public intellectuals, stand united and in solidarity with Dr Azmi Sharom whose only alleged ‘crime’ is to think and to publicly share his considered opinion on matters related to his professional expertise as a law professor.

Reportedly, all Dr Sharom did was to caution the Selangor Pakatan Rakyat to not resort to the Court of Appeal’s ‘landmark’ ruling of effecting a transition of government and Menteri Besar in the Perak case but to revert to the universally accepted convention of testing its support and its candidate for Menteri Besar in a vote of confidence in the state assembly. What’s so seditious about that?

Charging Dr Azmi Sharom with ‘uttering and publishing a seditious statement’ only shows up the hypocrisy of this government. After all, does not this same government also employ Dr Azmi Sharom to teach students about our legal system, to undertake research, to study judicial pronouncements and to opine what constitutes justice within a democracy? Does it not defeat the very purpose of his work and indeed the work of thousands of other academics within a nationwide university system if he is to be summarily hauled up for merely doing his duty as an academic?

Charging Dr Azmi Sharom with ‘uttering and publishing a seditious statement’ for his informed views reveal the lack of respect this government has towards the universal principles of academic freedom and freedom of expression. By its actions, this government reveals it is led by politicians who are unable to appreciate civilized democratic values nurtured by enlightened universal education. Prime Minister Najib Razak’s on-going mantra of commitment towards academic excellence, democracy, government and economic transformation rings hollow.

We are of the view that, as long as one does not espouse violence or promote hate, there is no law in our modern world that can justify the criminalizing of thought and public speech. Indeed, the colonial-era Sedition Act 1948 under which Dr Azmi Sharom is being charged only indicates a painful irony, namely after 57 years of Merdeka we remain shackled and oppressed by the very government that claims to have freed us from British colonial rule.

There is no place in a modern, progressive and democratic Malaysia for an archaic, backward and oppressive law that is the Sedition Act 1948. It is a repugnant law and must be repealed. It runs afoul of our fundamental liberties as enshrined in our federal constitution. It runs afoul of the Universal Declaration of Human Rights. And it runs afoul of our nature as enlightened human beings with thinking minds.

Free Dr Azmi Sharom from this perversion of justice, now! Free Malaysia!

面對北京箝制，香港的民主路怎麼走？
社論/聯合報
中共人大發表的「政改方案」，對特首選舉悍然畫下多道紅線，否決了港人極力爭取的「真普選」；此舉，不僅撕裂了香港和北京的信任關係，也將把香港推向新一波動盪。對香港人而言，這誠然是一大挫折，但要如何在挫折中繼續向爭取民主推進，恐怕須放長眼光、冷靜思考，不要被一時憤怒和憂慮淹沒。這次中共人大常委會通過的決議，連平日態度溫和的香港人士都感到失望，主要原因是北京不僅寸步不讓，更強硬緊縮了鳥籠政治的尺寸，讓港人覺得北京是刻意打壓，使「一國兩制」的承諾倒退。香港泛民主派人士感到最不安的，是幾項箝制：第一、中共人大明確規定特首人選須由「提名委員會」產生，排除了政黨提名等其他途徑；第二、規定提名委員會僅能提二至三名人選，且均須獲一千兩百人提名委員的「過半支持」，這項規定使民主派人士入圍的機率大大降低；第三、人大表明，立法會若無法就其宣布之原則制訂出具體辦法，香港特首選舉便繼續沿用舊制由「選舉委員會」推選，而無法實施港人普選。綜合觀察，一般港人和學生最氣憤的是上述箝制的第一點，即中共雖同意普選，卻拒絕用更開放的方式接受各界提名，提名對象僅限「愛國愛港」人士，這是刺激港人參與「占中」行動的主因。進一步看，實際上更困擾香港泛民派人士的卻是第二及第三點，這不僅使他們陷入一個「名進實退」的處境，更挑撥了他們和一般香港市民間的矛盾。所謂「名進實退」，現行特首選舉辦法只要獲得推選委員會「八分之一」委員的同意，即可成為候選人；泛民陣營目前雖屬少數，仍有機會推出自己的候選人。然而，北京將門檻一舉提高至「二分之一」，極可能使民主黨派完全失去參選的機會。亦即，名義上，香港市民雖得到了普選的機會；但就香港的政治而言，民主陣營卻可能因門檻抬高而失去競逐的機會，這是實質的政治打擊。為此，在七十名立法會成員中，已有廿五名泛民派議員發出聯合聲明，稱全力支持「占中」行動，並將在立法會投票否決人大的方案，封殺不合理的特首選舉辦法。然而，如果新的辦法不通過，意味香港的特選仍將維持昔日的「小圈圈選舉」，無法進行公民「普選」。如此一來，泛民派可能被對手扣上「阻撓普選」的罪名，甚至以「占中」指控他們「不顧香港的安定繁榮」，離間香港市民對他們的認同。這點，泛民派必須仔細衡酌、技巧因應，才不致使香港好不容易獲致的民主成果化為烏有。中共這次的鐵腕，一是對香港的民主派及它所謂境外勢力的介入不放心，二是擔心「香港模式」對內地造成示範與衝擊，三是要顯示北京不受「占中」行動威脅。民主派人士的解讀是，中共其實根本無意讓香港實施普選，才會訂出如此高的門檻，要讓民主派知難而退。但無論如何，目前的情勢，對泛民派確實是一個兩難的局面：硬衝的話，可能損及香港安定；退讓的話，則可能使自己失去立足之地，因此必須謹慎評估拿捏。目前看來，「占中」行動已經箭在弦上，不能不發。尤其香港年輕的一代，難以容忍這種民主寸進如此艱難的處境，勢必不受節制。但對於政界、法界乃至其他領域的問政者而言，恐不能將全部希望皆寄於街頭路線，而必須維持體制路線或議會路線的平行並進。這次不少香港人取法台灣「三月學運」的經驗，高舉「公民不服從」之標語向北京示威；事實上，兩者相提並論是一種不對稱的思維。三月學運面對的是一個相對柔軟的民主政權，且只是訴求單一議題；然而，香港面對的民主議題要巨大許多，站在其對立面的北京是比一黨獨大時代的國民黨政權還要強悍，更毫無民主經驗可談。這點時空及主客觀形勢上的差異，香港民主派必須靠著更長時間的經營來扭轉，不可能一廂情願。在中共人大宣布香港政改方案之日，澳門特首崔世安在小圈圈選舉中以九成六的得票率成功連任；一海之隔，港澳兩樣情。香港對民主鍥而不捨的追求，令世人動容，但這不是一蹴可幾之路，需要日久天長的部署、積累、對話與抗爭；畢竟，台灣走了卅年的民主道路，也不過如此。

大马著名歌手梁静茹因为在面书高调力挺在吉隆坡展开的428黄绿大集会结果惹祸，身为大马旅游大使，在旅游部长黄燕燕的压力下，她被迫10分钟内删除其面书所有关于这次大集会的帖子！

据《光华日报》昨天的报道，目前人身在台北的静茹，是于昨日中午12时在其面书专页通过手机留言，写道“我被下令删除所有关于黄色活动的帖，请告诉大家我会在10分钟内删除”，接着这个留言在5分钟后即消失，而之前所有关于梁静茹针对428大集会的留言及转帖，都宣告删除。

静茹较后在下午1时，又重新在其专页留言，内容为“正义是存在的，争取是存在的，勇敢是存在的，我也给大家深深一鞠躬。催泪弹催出的泪只会让大家更团结更坚强，那泪深深烙印在我们的心里。”

内容并没有明显谈及428，可是透过文中的催泪弹，大家肯定知道她是针对428黄绿大集会事件发表本身感受，并获得了超过1300名粉丝按赞。

在每天骂丹州回教党极端的时候，是不是应该看看一下自己所谓的堡垒州属，是不是真的很开明？如果你说回教党是保守，我想回教党的确是《真保守》，如果马华说巫统是很开明的，我也会说的确问题是《假开明》。当今大马的新闻标题《柔州娱乐业者被令先知日休业马华行政议员声称未听闻禁令》马华却说不知道？真的是笑死人了，说到这个宗教日所有娱乐场所必须停止营业24个小时，柔佛早在若干年前就已经实行的“不公平政策”，这个连阿嫂都知道的公开事件，年年如此，如果国阵继续政治可能会世世代代都会如此。占有相当大华人比例的柔佛，真的很开明吗？看看今天这个停业24小时的勒令就一目了然，再看看被令停工的居銮普照寺吧，就算20年后的今天可以复工，但是你看看那几条复工条件，佛都有火啊，连佛都不给人拜的佛寺世上何寻？最后马华能做的就是叫居銮华社别“节外生枝”。

BASTARDISATION OF BRITISH COLONIAL OFFICERS

There is no completely reliable estimate of how many people left Britain for a new life overseas during the years of empire, but most of them never returned, and, by 1900, a majority of English-speakers were living outside Europe. The British diaspora created a network of family connections stretching from a grey, damp island in the North Atlantic to dusty sheep stations in Australia, rough-and-ready mining towns in Africa and snowy wildernesses in Canada. So, while at any one time the imperial life was being lived only by a minority of the population, the colonial experience was familiar to many more.

When the British went to live in the lands they conquered, they were confronted immediately with the question of what made them distinct from the people among whom they lived. Indeed, when you read the popular literature of the period, its most offensive characteristic is the assumption of racial superiority over “brutes” and “savages”. As Cecil Rhodes put it, “We are the finest race in the world and the more of the world we inhabit the better it is for the human race.”

As the empire matured, a peculiar illogicality seized the British: we rule more of the world than any other nation, therefore we must be superior to any other nation. In fact, of course, it was technological advance and entrepreneurial flair which gave birth to the empire. But a belief in some moral pre-eminence offered reassurance to the anxious imperialist. For the majority of empire officials – district officers and magistrates, policemen, teachers, farmers and engineers – the role was perhaps justification itself.

Yet it was a role in an alien land, and the customs and conventions of Hove or Huddersfield were absent. So the daily business of living in a British community – even a community of one or two, out in the bush – required the invention of a set of norms, of things which were done at certain times of the day, and things which were definitely not done at any time. These communities were obliged to define what being British meant. In the bungalows and clubs, the sundowners on the verandah and the suet puddings at the dinner table, they were acting out a version of what life was like at home. But it was a not-quite-perfect representation.

Creating and running this enormous enterprise required a certain type of individual, which gave Britain its idiosyncratic public-school system, designed to produce not intellectuals but “sound chaps” – capable, dependable, resourceful.

PARAMESWARA MALAYSIA OR SHOULD BE CALLED AS PARAMESWARASIA??

Parameswara the Prince from Majapahit,Java landed in Muar,Johor in 1399/1400 AD(or earlier 1250?) and later established the Malay Sultanate of Malacca from 1400 to 1511.
From 1511 to 1951,Malaysia evolved from being ruled by the Portugese(from Portugal),the Dutch(from Holland),the British(from UK).Between the rule of the Dutch and the British,Malaysia was nearly ruled by the French,if not for the deals between the Dutch/British that resulted in the British taking Malaysia and the Dutch taking Indonesia.Then there was a short stint by the Japanese(1942-1945) and the failed attempts by the Communist(1946-1989)....These are HISTORICAL facts,which have already HAPPENED..!

Finally between 1955 to 1957,the British agreed,but on condition that the other races,the Chinese and the Indians,BROUGHT in by the British in the late 1890s,(to work in the rubber plantations & tin mines )are to be included in the INDEPENDENCE of Malaya process,whereby there were a few conditions;

like CITIZENSHIPS of those who were already in Malaya by the year 1955;LANGUAGES;EDUCATION; RELIGIONS and the Malay's SPECIAL RIGHTS and the SULTAN SPECIAL POSITIONs.
THESE,again were and are HISTORICAL FACTS,some are written,some are mutual understanding at that
time,some are unwritten understandings...

Umno did not revoke Terengganu Hudud under Umno rule now ....

Hudud Law is only meant for the muslims. But Umno makes it a mockery by saying that there will be chaos in this country if Hudud Law is being implemented because Malaysia is a multi-racial and multi- religion country.

Whereas Hudud Law has got nothing to do with the non –muslims since they could easily opt to the present British Colonial Common Law or Civil Law for that matter. Which is not even a Chinese, or an Indian Law or even a Christian, Hindu or Buddhist Laws in reality.

Being a democratic country , Hudud Law i.e. The Syariah Criminal Enactment 11 was passed by the Kelantan State Assembly in 1993 and The Syariah Criminal Enactment was passed by the Terengganu State Assembly in 2003 respectively. This is in accordance with the procedures of democracy engaged by PAS in its Islamic political course and plights which is contradicted with the speeches of Umno leaders right from Tunku till Najib. Such as Hudud will stop development and not all Muslim States implement Hudud. Making it a plain mockery and a criminal defamations toward God as The Absolute Law Giver , Islam and the muslims at large.

Umno says, “ Hudud in Kelantan and Terengganu is PAS’s Hudud” and where is Umno’s Hudud? . Umno says, “ Hudud is in the Qur’an “ but any lay man for that matter (not law-man) will tell Hudud in the Al-qur’an and the Al –Hadis ( Traditions of the prophet ) must be legalized first in the State Assembly and in the parliament as such Umno is the blockate of Hudud Law all these while by sending a letter of threat to the Kelantan Government not to implement Hudud. When Mahathir said,” Why TGNA not implementing it when he’s no more the PM “ has proven that he had bulshited all the yes man leaders and followers of Umno that Umno is the biggest Islamic party in Malaysia but he himself makes Hudud a mockery and played escapism whereas Hudud is the responsibility of all muslims to practice it as to the 5 time prayer , pilgrimage, zakat and fasting as obligatory practices as ordained in the Qur’an.

Any where we go in the world , one will never find a Buddhist Court, a Hindu Court , a Christian Court or a Judaism Court for that matter . But for the muslims there’s such religious court known as The Syariah Criminal Law pertaining to i) Hudud Law i.e. i) Syariqah( burglary), ii) Hirabah( Arms Robbery ), iii) Syurb( Intoxicants), iv) Adultery, v) Qozaf( Accussations of adultery and Sodomy without four eye-witnessses ) and vi) Apostacy which is only meant for the followers of Islam i.e. Muslims . Even the Medina Charter of the prophet First Benevolent Government in Islam did not abide the Jews , Christians and pagans to follow ii) Qisos ( Batteries and causes of injuries ) and iii) Taazir ( Judge verdict not beyond Hudud punishment which is not in Hudud or Qisos ) such as drugs crime which is not supposed to be hanged right away as in the present Civil Law or pardoned a hang sentence except for the benefacaries consent with a certain amount of compensations agreed upon by both parties.

The idea of Hudud is to protect the muslims i) Faith, ii) healthy and sober mind iii) lives from being raped or murdered , iv) genuine and clean siblings and v) protect the property . Thus Islamic Law is not to punish but to educate the people and their sins being pardoned if they were to be sincere . acceptable and surrender to God in return they are free from the sins committed in the hereafter. An Islamic System of a Benevolent Government is not merely in this world ( unlike Umno until 2020) but until the hereafter as our future and eternal world or the actual permanent state we are heading to.

But Umno’s hudud mockeries have created fear amongst the muslims themselves condemning without understanding . But with PAS out-reaching of the true teachings of Islam right from its first President Tuan Hj Fuad 60 years ago i.e. in 1951 PAS was formed in Butterworth That was when The Ulamaks left Umno and formed PAS for they didn’t agree with gamblings approved by Umno till now which is different from Kelantan.

PAS leadership was then taken by a modern time ulamak who wrote the book on “ Symposium Tasauf “ was well respected of his depth religious knowledge who was also the first Malay Doctor in Homeopathy medicine i.e. Professor Doctor Burhanuddin Al Helmy and his Deputy , Professor Doctor Zulkifly Muhammad. Prof. Dr. Burhanuddin once was invited for an international meeting known as The Asia-Africa Conference for the first time held ; where he was the only one representing Asia and Malaya and South East Asia for that matter as one of the masses freedom fighters leader against colonizations and imperialism

Where Umno did not revoke Terengganu Hudud under Umno rule now and MCA and Gerakan did not withdraw from BN as for the Syariah Criminal Enactment in Terengganu being accepted by them since 2003. Whereas DAP and PKR and PAKATAN acknowledged the Hudud Law approved in Kelantan and Terengganu prior to the formation of Pakatan Rakyat. Congratulations Pakatan ! killed Umno stratagies stabbing itself for good ! Promote Orange Book and Pakatan Rakyat Common Policy Platform for a New Malaysia !

In the matter of DAP , PKR and PAS interpretations of the Civil Criminal Law, Federal Constitution and the Syariah Criminal Enactment in particular to be implemented in Kelantan; have plenty of rooms to be discussed with .With the acknowledgement of Pakatan towards Hudud in Kelantan and Trengganu . It could be proceeded fairly through a “ Constitution Court” yet to be formed in considering that Religion Is within the absolute power of the Sultans and States without Sultans is the Agong. And Islam is the official religion of Malaysia in its real meaning not secularized i.e. Islam as i) “ Ad-deen Waddaulah and ii) Ad-deen wa syariah “ promoting A Benevolent Islamic System of Good Governance and just to all and other religions are free to practice there to.

With all due respect to all the non-muslims as a whole and PAS SUPPORTERS WING , DAP and PKR. explain why the polic

3.1 Topple Opposition State Governments

Let us look at some examples in the past:

1. Singapore 1965: Singapore joined Malaysia on 16 Sept 1963.

The state government there was led by Lee Kuan Yew (LKY) of

the PAP. He was trying to gain a foothold in Peninsular Malaysia

through his slogan of Malaysian Malaysia. The Alliance Party then

(consisting of UMNO, MCA and MIC) saw him as a threat to their

Chinese support base. UMNO triggered riots in Singapore to

create the conditions to declare a state of emergency, to arrest

LKY and take over the state government.

The British who still had the Commonwealth Army around to

defend Malaysia from Sukarno’s Confrontation against Malaysia,

were not in favour of such unconstitutional tactics and actively

discouraged it. So the Prime Minister of Malaysia, Tunku Abdul

Rahman, did the next best thing – expel Singapore from Malaysia

on 9 Aug 1965.

2. Sarawak 14 Sept 1966: Stephen Kalong Ningkan

case.colluded with the Sarawak State Governor to

dismiss the Chief Minister, declared a State of Emergency

and installed her

own state government.

3. Kelantan Dec 1977: PAS toppled by BN through a

Declaration of Emergency.

4. Sabah 1985 to 1994: How the BN toppled PBS. and here.

Over a period of 9 years, UMNO tried various means to topple the

opposition PBS until she finally succeeded in 1994 by luring PBS’s

state assemblymen through cross-overs.

In all successful cases, UMNO was helped with the acqueiscence

of the State Governors/Sultans. They also took advantage of the

fact that the State of Emergency in Malaysia was never lifted

although the event that triggered the Emergency had long since

gone. They kept it ready to be used as and when necessary.

07 May 2009 Perak Coup

Previously, through total control of the media, UMNO could

determine the information fed to the Rats. This allowed them to

control public opinion and suppress any attempt to resist the

coup. This time round, with the advent of the internet (new

media) and modern technology, what UMNO did in the Perak

Assembly was broadcast live to the nation and the world. The

scenes of plain-clothes policemen masquerading as officials of

the Sergeant-at-arms manhandling the Speaker and dragging him

out of the Assembly will remain in the minds of the Rats for years

to come. During the next general elections, it will come back to

haunt UMNO.

What were these powers that

the best in the world, to suppress any challenge

to the government.

2. The military and the police as the

enforcement arms.

3. The National Registration Department to

control citizenship

protégé was never to lose a general election.

today attest, they mastered the art of winning

elections. Over the years, with the help of her

intelligence services, UMNO refined and

expanded the powers at her disposal, until it

has become her War Machine – a fearsome

power that struck terror in the opposition

parties.

It was an alliance of nations made up of Austria-Hungary, France, Germany, Italy, Japan, Russia, the United Kingdom, and the United States that invaded China around 1900 for imperialist trade purposes. These countries were soon fighting each other in largely imperialist world wars. My guess is we have as little clue now of what is brewing up.

What is important is not butchering history to create your own truths. You cannot change your race even if you convert–Parameswara could not have been responsible to UMNO’s stupidity and false sense of heritage thro ‘Ketuanan Melayu’. If this is what it is based on,there is no ‘Ketuanan Melayu’ because the lineage of Melaka Sultans was an Indian and a Hindu Prince. It is clear from records that Parameswara never converted to Islam.He was an Indian Hindu who fled Palembang in Sumatra to eventually found Melaka circa 1400 AD and start the entire Malaysian royalty. Malaysian royalty was and is of Indian/Hindu origin. On the other hand it was Sri Maharaja who converted himself and the court of Melaka to Islam,and as a result took on the name of Mohammed Shah sometime after 1435. But what is really sad is that our children are taught as though Malaysian history suddenly began in 1400 with an Islamic Melaka. Even the Malays themselves are being cheated by UMNO into believing that everything started around 1400.WE are also led to believe that the Indians and Chinese first arrived on the shores of Malaysia only around 1850 as desparate indentured labourers,farmers and miners. NOTHING COULD BE FURTHUR FROM THE TRUTH. The cultural influence of India in particular,and China in South East Asia span over 2000 years starting perhaps with the arrival from India of the Brahmanical prince/scholar–Aji Saka in Java in AD 78, thro to Vietnam,Cambodia(Indo-China)Thailand,Burma,Indonesia,Bali,Borneo and beyond. Malay culture is Indian culture.In fact the whole of South East Asia is heavily influenced by Indian culture. The findings at Bujang valley speak of an ancient Indian/Hindu presence in Kedah.There were Chinese settlements in Pahang and Kelantan around the 13th-14th century and in the 12th century Singapore.The early Brunei Sultanate had a Chinese Queen. One need not ponder at length the implications of Angkor Wat and Borobudur or that 40%-50% of Bahasa Malaysia comprises Sangkrit/Tamil words.But all of these are hidden away from the rakyat inc the Malays themselves so the Malays in particular grow up with limited knowledge of their own country and heritage. An important archeological find that pointed to one of the greatest empires of all times in history–Raja Cholan empire that ruled from the Maldives thro India,Sri Lanka and right down to South East Asia found deep in the jungles of Johore a few years ago and made headlines in the main stream newspapers in 2005 suddenly disappeared from the news.
