Sejarah jelas memaparkan PELOPOR-PELOPOR/PERINTIS-PERINTIS pejuang merdeka yang sejati




SAKSILAH PELOPOR DAN PERINTIS PEJUANG KEMERDEKAAN NUSA!!!

BENARKAH UMNO PEJUANG MERDEKA??? - CHEGUBARD


Parti Kebangsaan Melayu Malaya (PKMM) ini telah ditubuhkan pada 17 Oktober 1945 di Ipoh Perak. Parti ini adalah parti yang mula-mula sekali menjadikan "MERDEKA" sebagai slogannya, dan menjadikan warna merah dan putih sebagai bendera untuk parti PKMM.

Dengan selogan "MERDEKA" PKMM telah berjaya menghimpunkan seluruh rakyat Tanah Melayu tanpa mengira agama dan fahaman ideologi. Namun ia tidak mendapat sokongan dikalangan bangsawan Melayu dan juga kakitangan kerajaan (pro penjajah)

Pimpinan tertinggi PKMM pada awalnya dipimpin oleh Mokhtarudin Laso seorang yang amat keras didalam perjuangannya, namun beliau menghilangkan diri dan dikatakan bahawa beliau telah ke Sumatera Barat, untuk mengisi kekosongan yang ditinggalkan oleh Mokhtarudin Laso satu mesyuarat telah diadakan di 'Rumah Merdeka' di Kampung Bahru untuk menstrukturkan semula PKMM.

Struktur organiasasi PKKM yang baru adalah:

Yang Dipertua Agung : Ishak Haji Mohamad (Pak Sako)
Setiusaha Agung : Zulkifli Aoni

Ahli Jawatankuasa :
1. Abdullah CD (Cik Dat Abdullah)
2. Ahmad Boestamam
3. Musa Ahmad
4. Khatijah Ali
5. Abu Bakar Al Baqir

Aishah Ghani telah mengantikan tempat Khatijah Ali apabila PKMM berpindah ke Kuala Lumpur. 'Mak Inang' nama timangan yang digunakan oleh Aishah Ghani untuk penulisan akhbar rasmi PKMM yang bernama 'Pelita Malaya'. Aishah Ghani telah meletakkan jawatan setelah beliau menjawat jawatan didalam kerajaan British. Tempat beliau kemudiannya diisi oleh Shamsiah Fakih dan Zainab Mahmud Baginda.

PKMM telah berkembang pesat dan digabungkan dengan pelbagai pertubuhan yang menjadi tulang belakang dan penggerak di seluruh Malaya, antaranya:

1. API (Angkatan Pemuda Insaf). Dibawah pimpinan Ahmad Boestamam. Diharamkan pada 18 Jun 1948 pihak penjajah British dengan persetujuan YDP UMNO Dato Onn Jaafar.

2. AWAS (Angkata Wanita Sedar). Diketuai oleh Samsiah Fakeh. Diharamkan pada 18 Jun 1948 pihak penjajah British dengan persetujuan YDP UMNO, Onn Jaafar.

3. BTM -Barisan Tani Malaya (BATAS). Ditubuhkan pada 7 Julai 1947 di Kajang. Ketuanya ialah Musa Ahmad. Setiausaha disandang oleh Abas manakala Mokhtar sebagai bendahari dan Kadir menjadi ketua bahagian propaganda. Pimpinan Negeri ialah Mokhtar - Kedah, Selangor - Musa Ahmad, Pahang - Abas, Johar - Kadir dan Negeri Sembilan - Ibrahim Baba.

4. Jabatan Kerja Melayu (JKM). Didirikan pada awal tahun 1946. Diketuai oleh Alimin, Setiausaha oleh Abdullah CD dan merangkap ketua bahagian selatan. Bahagian utara oleh Rashid Maidin dan bahagian timur oleh Kamaruzaman Teh.

5. Hizbul Muslimin.Ditubuhkan pada 17 Mac 1948. Tokoh yang terlibat ialah Ustaz Abu Bakar Al Baqir, Ustaz Abdul Rab, Dr Burhanuddin Al Helmy dan Kiayai Masyur Azahari. Pada 18 Jun 1948 pihak penjajah British dengan persetujuan YDP Umno, Onn Jaafar mengharamkan Hizbul Muslimin yang dianggap 'Parti Islam Merah' dan merupakan 'bahaya dari gunung' kepada mereka.

6.GERAM -Gerakan Angkatan Muda. Pimpinan Abd Aziz Ishak dan A Samad Ismail.

7. Kesatuan Buruh Melayu SeMalaya. Ditubuh pada tahun 1946 di bawah pimpinan Abdullah CD. Dipanjangkan penubuhan ke negeri-negeri pada 1947.

8. Pan Malayan Federation of Trade Union (PMFTU). Gerakan buruh berbagai kaum. Pada 1947, kongres telah memilih Ganapathy sebagai Pesiden, Abdullah CD sebagai Naib Presiden dan Chen Lu sebagai Setiausaha.

8. Kesatuan Opera Melayu.

9. Persatuan Pemandu Teksi.

10. PETA -Pembela Tanah Air. Ditubuhkan apabila KMM diharamkan pada 18 Jun 1948 pihak penjajah British dengan persetujuan YDP Umno, Onn Jaafar.

11.Majlis Agama Tertinggi Se-Malaya (MATA). Pimpinan Ustaz Abu Bakar Al-Baqir.

Pada tahun 1947, iaitu sepuluh tahun sebelum merdeka, PKMM memperkuatkan perjuangan menuntut kemerdekaan dengan bergabung dengan beberapa pertubuhan bukan Islam dan bukan Melayu dalam Malaya Democratic Union, membentuk Barisan Bersatu Putera-AMCJA.

Barisan Bersatu Putera-AMCJA ditubuh pada 1947 dan menggubal 10 fasal Perlembagaan Rakyat untuk kemerdekaan.

Antara gerakan yang dilakukan oleh Barisan Bersatu Putera-AMCJA yang sangat berjaya dan menggugat kedudukan British adalah mogok seluruh Malaya yang dikenali sebagai HARTAL. (video http://www.youtube.com/watch?v=sNZzZlVgWxY&feature=PlayList&p=F0B6BA1785FFE49E&index=0&playnext=1)

HARTAL telah berlangsung pada 16 September, 1947 yang telah mencatatkan sejarah satu mogok umum, di mana pada hari tersebut, satu aktiviti pun tidak dilakukan oleh seluruh rakyat Malaya.


Pada masa yang sama, British telah berpakat dengan Elit Melayu yang menubuhkan Pertubuhan Kebangsaan Melayu Bersatu (Perkembar – yang kini dikenali sebagai UMNO), menggubal satu lagi perlembagaan yang dipanggil Perlembagaan Persekutuan Tanah Melayu.

British tidak menerima desakan Barisan Bersatu Putera AMCJA, dan telah menolak Perlembagaan Rakyat dan menggantikan Malayan Union dengan membentuk Persekutuan Tanah Melayu serta melantik Dato’ Onn menerajuinya.

Barisan Bersatu Putera AMCJA dan seluruh anggota gabungannya, diharamkan pada 18 Jun 1948 pihak penjajah British dengan persetujuan Yang Dipertua (YDP) UMNO, Dato' Onn Jaafar.

British telah mengisytiharkan Darurat pada tahun 1948, dengan alasan menentang gerakan komunis di Malaya dengan menggunakan 'preventive detention' iaitu tahanan tanpa perbicaraan yang kemudian dikuatkuasakan sebagai Akta Keselamatan Dalam Negeri (ISA), mengambil tindakan menangkap sesiapa sahaja yang menentang.

Antara bukti bahawa Darurat 1948 diisytiharkan adalah semata-mata satu tindakan ’pecah perintah’ British adalah lebih 2,800 orang ahli-ahli gabungan Barisan Bersatu Putera ACMJA ditangkap dibawah ISA, termasuk Ustaz Abu Bakar Al-Baqir pemimpin MATA dan Hizbul Muslimin yang kemudiannya didaftarkan secara rasminya sebagai Parti Islam SeMalaysia (PAS)

3 Sept 1945 -

Tentera British menakluki semula Malaya melalui Pentadbiran Tentera British (BMA).

16 - 17 Okt. 1945 -

Parti Kebangsaan Melayu Malaya (PKMM) didirikan di Ipoh, Perak.

1 Mac 1946 -

Kongres Melayu Se Malaya, termasuk PKMM, menyarankan penubuhan UMNO.

11 Mei 1946 -

UMNO dirasmikan di Johor Baharu di bawah pimpinan Onn bin Jaafar.

1947 -

PKMM pamerkan bendera Malaya merdeka di persidangan Asia baru di New Delhi.

Selepas Malayan Union gagal, PKMM menarik diri dari UMNO kerana UMNO 'enggan' menuntut merdeka. PUTERA (Pusat Tenaga Rakyat) yang dipimpin PKMM - termasuk API (Angkatan Pemuda Insaf), AWAS (Angkatan Wanita Sedar), Hizbul Muslimin, BATA (Barisan Tani), BARA (Barisan Anak Rakyat) - bekerjasama dengan All Malayan Council of Join Action (AMCJA), yang dipimpin Malayan Democratic Youth League (NDYL), Persatuan Bekas Perajurit TAJRM, Persatuan Wanita dan Malayan Indian Congress (MIC).

14 Ogos 1947 -

India dan Pakistan merdeka (Arus kemerdekaan Asia dan Afrika serta lain-lain tempat bermula)

16 SEPT 1947 -

PUTERA - AMCJA memimpin mogok umum (hartal) di semua negeri menuntut kemerdekaan dan menentang Persekutuan Tanah Melayu cadangan penjajah.

Kerajaan yang wujud pada tahun 1948, lebih tepatnya Kerajaan Persekutuan Tanah Melayu sebenarnya adalah kerajaan kolonial Inggeris. Pertubuhan seperti PKMM, PETA, AWAS, Barisan Tani, Kesatuan Buruh dan lain2 telah melancarkan perjuangan sengit menentang kerajaan tajaan penjajah Inggeris ketika itu. PUTERA-AMCJA mengadakan hartal di seluruh negara adalah juga kerana menuntut Malaya diberikan kemerdekaan TOTAL ATAU PENUH

PELOPOR-PELOPOR ATAU PERINTIS-PERINTIS INI menentang rancangan Persekutuan Tanah Melayu tajaan penjajah jijik Inggeris dan TUNTUT KEMERDEKAAN penuh. Masa itu UMNO baru berumur 2 tahun bersama semboyan HIDUP MELAYU.

Bagaimana "seandainya" apa yang tercapai dalam Perjanjian Damai Haadyai antara Parti Komunis Malaya (PKM) dengan kerajaan Malaysia pada tahun 1989, disempurnakan 34 tahun lebih awal, iaitu dalam Rundingan Baling pada tahun 1955?

Sememangnya, adalah terlalu lewat untuk membuat sebarang "andaian" dalam sejarah. Apa yang berlaku telah berlaku dan berlalu. Namun, sejarah tidak harus tinggal hanya sebagai "bahasa" pemenang, atau pemegang kuasa, seandainya sejarah itu ditelaah untuk mengambil iktibar daripadanya.

Selama ini, Chin Peng selaku Setiausaha Agung PKM memikul beban sejarah ini secara bersendirian, atas tuduhan "enggan menamatkan perjuangan bersenjatanya". Untuk mereka yang membaca memoir Chin Peng, My Side of History, sikap provokasi Ketua Menteri Singapura pada ketika itu, David Marshall dalam Rundingan Baling, mungkin berperanan menggagalkan rundingan tersebut.

Namun, sebagai wartawan yang membuat liputan di tempat kejadian Rundingan Baling pada usia 27 tahun ketika itu, Said Zahari menganjurkan perspektif tersendirinya untuk menafsir peristiwa sejarah ini. Bekas Ketua Pengarang Utusan Melayu ini mendedahkan pengalaman yang terpendam dalam ingatan beliau di memoir dirinya, Meniti Lautan Bergelora.

"I never wanted it to be a success," Tunku

Dalam bab ke-44, Said Zahari mencatatkan pengalaman dirinya ketika membuat liputan di Baling sebagai wartawan Utusan Melayu. Beliau yang cuba mendapatkan berita esklusif pada ketika itu, dibenarkan untuk mengajukan satu soalan kepada Tunku Abdul Rahman, sebelum sidang akhbar bermula.


Satu-satunya soalan tersebut berbunyi, "Adakah Tunku menyesal dengan kegagalan rundingan ini?" Tanpa diduga, Said Zahari dibalas dengan jawapan, "No, I am not. I never wanted it to be a success." (Tidak, saya tidak (menyesal). Saya tidak pernah mahukan ia berjaya.)"

Jawapan ringkas dari Tunku ini bagaimanapun tidak disiarkan, atas "nasihat" Syed Jaafar Albar, anggota Penerangan UMNO yang ketika itu berada di sisi Tunku.

Dalam wawancara bersama MerdekaReview kelmarin, Said Zahari kekal dengan pendirian beliau, bahawa Tunku tidak berniat untuk menyelesaikan perkara ini dengan Chin Peng, kerana untuk Tunku, soal Chin Peng adalah masalah yang perlu diselesaikan oleh British, dan bukannya kerajaan Tanah Malaya.

"Chin Peng mahu tamatkan peperangan di situ"

"Padahal Chin Peng mahu tamatkan peperangan di situ," kata Said Zahari, "Apa yang terdapat dalam perjanjian 1989 sebenarnya could have been achieved in 1955. (Rundingan Baling?) Yes! The same thing, tapi Tunku tak mahu..sebab tu dia kata, 'memang aku tak mahu selesaikan'. This is the proof (Ini buktinya)."


Namun, apa yang bermain dalam otak Tunku, seandainya beliau ingin bertemu dengan Chin Peng, tetapi enggan menyelesaikan masalah dengan pemimpin komunis ini? Tokoh wartawan ini menganalisa Rundingan Baling dari perspektif percaturan politik, yang memenangkan kedua-dua pihak Tunku Abdul Rahman dan Chin Peng.

"Tunku mahu membuktikan bahawa Chin Peng terpaksa berjumpa dengan saya, Tunku Abdul Rahman (gambar kanan) pada waktu itu, bukan British. Dan Chin Peng mahu membuktikan Tunku Abdul Rahman sanggup berjumpa dengannya walaupun dia ketua PKM," jelasnya.

"Jadi itu, you win one, i win one-lah (Kamu menang satu, saya menang satu)." Said Zahari menyimpulkan politik "saling guna-mempergunakan" antara kedua-dua orang tokoh ini.

Wartawan menyusul dengan soalan "apa manfaatnya pertemuan ini kepada pihak Tunku, jikalau bukan untuk menyelesaikan masalah ini dengan Chin Peng?"

"Publisiti," Said Zahari menjelaskan selanjutnya, "Sebab dia (Tunku) pemimpin yang bukan sahaja diterima rakyat, tetapi juga pemimpin yang diterima oleh Chin Peng. Chin Peng sendiri cakap dalam perundingan itu, 'saya jumpa dengan Tunku sebab saya akui Tunku adalah pemimpin yang dipilih oleh rakyat. That is good enough.(Itu sudah memadai.)"

Pertemuan tidak direstui British

Tetapi, bukankah Tunku akan mencipta sejarah yang lebih besar, seandainya berjaya menyelesaikan masalah dengan Chin Peng?

"Sebenarnya, Tunku Abdul Rahman punya pertemuan dengan Chin Peng tidak direstui oleh British pada waktu itu, tahun 1955. British memang tidak mahu Tunku jumpa Chin Peng. Sebab British takut, (dengan) menemui Chin Peng, Tunku mengakui wujudnya PKM. Dan pada Tunku, menemui Chin Peng bererti Chin Peng mesti berunding dengan Tunku, bukannya British," ulasnya.

"Tunku menggunakan Chin Peng, untuk tunjuk kat (kepada) British, I dare to meet Chin Peng. British tak berani kasik (bagi) Tunku jumpa Chin Peng. Dia takut Chin Peng politik lebih, lebih hebat, lebih manipulative... sedangkan Tunku seorang gentleman, dan politiknya lebih konservatif," kata Said Zahari.

Malah, Said Zahari mempercayai bahawa British sebenarnya mengenakan syarat untuk pertemuan antara Tunku dengan Chin Peng. "Sebab British sudah warning, ini walaupun tak ada bukti tapi saya percaya, (British berkata kepada Tunku) 'you cannot solve the problem, you don't make any agreement with Chin Peng!"

Seandai situasinya begitu, mengapa pula British gagal menghalang pertemuan antara Tunku dengan Chin Peng?

Kembali kepada percaturan politik Tunku, Said Zahari menganalisa, "Pada Tunku, penyelesaian dengan Chin Peng seharusnya British punya isu. Dia (Tunku) sedang memperjuangkan kemerdekaan. Dia menggunakan Chin Peng. (Tunku mungkin menyampaikan mesej kepada British) I can cooperate with Chin Peng. We can fight you if you don't give me."

Tunku or Chin Peng?

"Saya percaya Tunku mesti berkata sedemikian dengan British di London. You want me or you want Chin Peng, or you want Chin Peng and me?" kata Said Zahari.

Beliau meneruskan analisanya, "You give to me or you give it to Chin Peng. It is up to you. But if you give it to me, then you selamat sikit. I think on this ground alone, British terpaksa (memberi kemerdekaan kepada Tunku)."

Pengamatan bekas Ketua Pengarang Utusan Melayu ini merumuskan, walaupun kemerdekaan tercapai seolah-olah perjuangan daripada pihak Tunku, tetapi tekanan sebenarnya datang dari pihak PKM.

"Disebabkan perjuangan bersenjata?" Soalan wartawan dibalas dengan tangkas dan tegas, "Yes!" sebelum Pak Said (gambar kiri) meneruskan, "Bristish can't afford to meneruskan perjuangan itu, too costly."


Demikianlah pengamatan dan analisa dari kaca mata seorang tokoh wartawan, Said Zahari mengenai sejarah kemerdekaan tanahair dan perjuangan PKM. Maka jelaslah mengapa bekas Ketua Pengarang ini mengeluarkan kenyataan bahawa Chin Peng adalah bumiputera Malaya, dan menyaran agar "perikemanusiaan" harus mengambil kira pihak PKM yang turut menyumbang dalam perjuangan kemerdekaan. KUALA LUMPUR: PKR supreme council member Zaid Ibrahim has diagnosed Dr Mahathir Mohamad with a psychological disorder, which has rendered his mind "convoluted and confused".

And a tell-tale symptom of this condition, according to him, is the former premier's "obnoxious and extraordinarily stupid" statement.

Commenting on Mahathir's latest blog posting on meritocracy, Zaid also took a swipe at the latter's Indian roots, by describing himself as "not just a Malay by constitutional definition, but by heritage (as well)."

In his posting, the former premier had labelled those who pushed for meritocracy as being just as racist as those who defended Malay rights.

Mahathir added that some Malays, “perhaps due to mistaken pride”, supported meritocracy and undermined the Malay position further.

However, Zaid disagreed.

“Many Malays want meritocracy for very good reasons. They want their applications for contracts and projects to be given fair consideration by the authorities. They do not want only those who are politically connected to have the upper hand. They want a level playing field.

“They believe that they can succeed on merit if only they get a fair chance. They want to succeed with their pride intact; and at the same time they want to tell their children that Malays who work hard and with the right attitude can succeed., like everybody else,” he said.

Zaid said many Malays wanted meritocracy so that they could get their dues like promotion and higher positions by working hard.

“They want to be judged fairly and not lose their position or seniority because some one else has the right political cable. They want a promotion system that is transparent and free of interference.

“They want to say that they have succeeded because they did it the hard way. Why does Mahathir have to belittle these Malays? Why must the Malays be scrapped off their self-respect just to prove that Umno is responsible for everything in this country?” he added.

'This is not misplaced pride'

Zaid, a former Umno leader himself, said he failed to understand why Malays who supported meritocracy were described as having misplaced pride.

On the contrary, the former law minister said, it was these Malays who carried the flagship of a proud people.

“We know our strengths and we have no shame of our limitations. But we will always strive to better ourselves. If by open competition and transparent policies the net effect is that some Malays still need extra help and support, then of course a responsible government will have to step in; to provide the incentives and the safety net to bridge the gap.


“But let us start with the notion that we must earn our success like everyone else. And the let the best amongst us prosper. We do not need to be instant millionaires. We can take our time so long as we work hard. All we want is the best education for the Malays,” he added.

Zaid said that his comments were aimed at reminding Mahathir of how wrong he was, and not because he had misplaced pride.

“Misplaced pride for a Malay is when he gets to be a minister because his father fixes it; or he has a few hundred millions in his coffers because he has the right Chinese partner to enrich him,” he added.

Sebuah syarikat yang dimiliki oleh anak-anak Ketua Menteri Sarawak, Tan Sri Abdul Taib Mahmud berjaya memperolehi tiga bidang tanah di Kuching pada harga yang tersangat rendah. Tindakan itu menyebabkan kerajaan negeri itu kehilangan potensi pendapatan RM300 juta.

Ahli parlimen Bandar Kuching Chong Chieng Jen yang membuat pendedahan itu berkata kerajaan negeri telah memperuntukkan seluas 269 ekar di bandaraya itu kepada Monarda Sdn Bhd pada harga yang jauh lebih rendah daripada harga pasaran iaitu pada kadar purata RM291,000 bagi setiap ekar.

Monarda diterajui oleh ank sulung Taib - Abu Bekir, yang memegang 52 saham dan seorang yang dikenali sebagai Choong Sun Nam, yang memiliki 12 saham.

Pemegang saham lain termasuk, anak perempuan Taib - Jamilah dan Hanifah Hajar, serta menantunya Anisa Hamidah Abdullah, yang masing-masing juga memegang 12 saham.


Chong, yang mengesan kaitan keluarga Taib itu melalui semakan pendaftaran tanah dan syarikat berkata pengasingan tanah itu adalah yang terbesar pernah dilakukan.

"Tanah ini sekarang adalah kosong dan Monarda tidak menjalankan sebarang urusniaga sejak ia ditubuhkan,” katanya.

Awal tahun ini, tiga aduan dibuat kepada Suruhanjaya Anti Pencegahan Rasuah Malaysia yang mendakwa Taib dan keluarganya menggunakan kedudukan mereka bagi menguasai empayar hartanah bernilai RM3 bilion.

Dua dokumen didedahkan di laman sesawang Sarawak Report yang mendakwa Taib menggunakan proksi bagi mengawal kepentingan sebuah syarikat yang berpangkalan di Amerika Syarikat, Sakti International Corporation, yang ketika itu bernilai US$80 juta (RM250 juta).

Touch N Go

Ive been using the Touch n Go card for quite some time, and never had much issues with it. Ive found it really useful especially with the SmartTag device. This is a rant about the little interaction I have with Touch n Go Sdn Bhd, and why they suck.

A few weeks ago, I got denied entry with a bizzare message "Kad Tamat Tempoh". I never new TnG cards could expire! Because of this, I was inconvenienced in having to queue up and pay cash in the manual toll booths.

The problem was that whenever I use any toll booths, its either after work hours, or the TnG offices would be at the opposite side of the road.

So this morning, I decided to spend two trips around the Ulu Klang Elevated Highway (thats 2 x RM1.50) just to get to an open TnG office. I asked the lady at the counter if she can renew my expired card, and she said sure. Just fill in a form. Great.

So while I was doing that, she punched in some stuff in her keyboard, and when I was done, she handed me a shiny new TnG card. Hooray, I thought, that was relatively painless.

Until I looked at the receipt:

What was interesting was that there was a Card Price! WHAT? I just needed them to extend my card expiry! So I asked the lady what was this about.

She said that:
"its standard policy, and instead of taking money, we've deduct it from the Deposit amount."
"Gee thanks, but it doesn't explain why you have deducted RM10 in the first place"
"A new card costs RM10"
"But I've just given you my old card to exchange!"
"Ive given you a new card"
"Its your own companies arbitrary expiry ..."
"Yes, the card expires after 10 years."
"So when does this card expire?"
... she checks the computer and says:
"on 17th April 2016"
"But thats just over 8 years from now: Whats this about 10 years?"
" .... "
"What's this about returning my deposit? My Old Balance was 70, you deduct 10, so why isnt my new balance 75?"
"No, I entered the old balance for you. Previously it was 65"
... I have no way of verifying this. *grrr* Why doesnt the receipt correctly read what it should read? Why can there be manipulation on their end?
"So who can I talk to about this?"
"You can call the Customer Hotline below ... "
"No, do you have a manager?"
"No, we are just resellers ... I too have to call the hotline when I need help"

So it looked like I was not going to get anywhere with this drone. I then checked their website, and found this helpful warning:

This is consistent with my experience, so I just would like to know why TnG charges for a new card in the first place.

A deposit model is almost bearable. Considering that people will be loading these pieces of plastic with their own money, if they lose it or abuse it, then its their fault and their monies should be forfeitted. The "loss" to TnG is minimal if not at all: they gain when people do silly things with their cards.

So what justifies them charging people for using their tickets?

Do credit card companies charge for cards? Do LRT companies charge for those paper tickets? No! The cost of the tokens are covered by the services paid for by the consumer.

Its completely unjustified to charge for something which would arbirarily "expire" after a few years.

Plus what is the story about reducing the expiry date to 8 years? The warning merely says "give you more years of driving", and doesnt quantify the next round of expiring cards.

I checked my MyKad (as I've loaded a few RM in it for LRT usage) and she said that it expires in 2050. Er ... why should there be an expiry at all? What is going to happen in 2050 when everyone's MyKads "expire" because of a third party? Will there be IC counters at all TnG outlets while they "exchange" cards again? Gah.

On speaking to my colleagues, it seems Touch N Go have other scams which they run. They have a loyalty card which refunds 5% off your toll usage. However there are hoops to jump through. These refunds only kick in IF you use more than RM200 per month! My colleague who lives in Klang and therefore pays more toll than an average KLite, says that he barely makes this "quota".

Some months like February and holiday filled months make him miss the alloted amount, and he loses out on the RM10 rebate. In addition, there is an annual membership fee of RM20. Plus you have to physically go to an outlet to redeem your rebates. It renders the "loyalty card" completely useless, if not frustrating.

So Touch N Go, what are you up to really? Your "Quality Statement" says that:

TNGSB aims to enhance customer satisfaction by complying with the requirement of the Quality Management System (QMS) and continually improving the effectiveness of QMS
I have no idea what this QMS is nor what it defines but judging from my interaction, I'd say it can be very spectacular.

Also, why is it that when we use TnG in carparks, its costs more? Are you charging the carpark operators a surcharge on the traffic? These shortsighted scams of yours certainly hinders on your Mission Statement:

To provide secure, swift and convenient cashless payment mode to all
Pfft.

Ten years on, and we don't have a cashless card as prevalent as Singapore's or Hong Kongs. With 3rd World mentality like TnG, you'd just have to wonder why.

Yes, its a rant, and Im pissed.

Same sad thing happened to me as well...
I was forced to change my Touch N Go on 5th Jan 2009 because of "Kad Tempoh Tamat". The strange part is my SmartTag still able to get the balance from the card! So I asked the customer service at Faber Tower while renewing my card and she answered me :

"Ini batch pertama berlaku macam ni. Kita hanya ikut arahan saja"
"Kad yang baru akan expire lepas 10 tahun?"
"...." (she kept quiet)
"Jadi, saya punya I.C. dan MMU student card juga akan expire?"
"...." (she kept quiet and smiling)

So ended up, I paid RM10 for the new card and get no answer for my questions.

Just imagine, every Touch N Go users have to renew their card every 10 years and there are 4.4 million users out there. That means Touch 'n Go Sdn Bhd will get 44 million every 10 years by just renewing the card!

Plus came out with another scam, PLUS MILES card.
1) The rebate for the card is 5% with the minimum usage of RM200/mth. Which is equivalent of a RM10. Based on the T&C, redemption of the rebate is subject to RM0.25 processing fee. This is deducted from the amount of Redemption. Redemption can be made ONLY at the PLUS Customer Service Centers.
2) You need to pay RM10 annually.
3) If you forget to redeem and wishes to terminate, all rebates amount will be cancelled.
4) Toll rebate is valid for 12 mths.

i love your stories on TNG as i was about to buy the plusmiles card. And now im thinking, i shouldn't bother at all.

All I'm saying, at small toll gates exits, let say, Senawang.. or Kuala Lipis, they don't have smart tag lane. they have tng lane sharing with with tunai. The problem is, when there's heavy traffics, (raya time or holidays time) this line cause massive jammed. And i was wondering, why the heck am i paying for the cashless and faster service of smart tag if i have to que like this?! right? if these people don't own tng, that's their problem, and they should just que on the tunai lane. cus they're not paying the stupid tng company. right??

and the other thing is, when theres 2 exits after the toll gates, and the smart tag lane are way at the end of the corner while my exits are at the other side of the world. so i have to cross all the way until the end, u can see this example at gombak toll. or worst, if i want to go to the toilet at their tolls office.. its also at the end of the smart tag lane..

why can't they just put the smart tag lane in the middle? or if they want to make 2 of them at the gate, why can't they put it near to each corner?

menyusahkan orang saje. got brains but dono how to use properly.

Pakar Patologi dari Thailand, Dr Pornthip Rojanasunand memberitahu Mahkamah Koroner di sini semalam, setiausaha politik, Teoh Beng Hock tidak membunuh diri.

Beliau berpendapat selepas meneliti autopsi kedua mayat Teoh. selain tidak membunuh diri, bedah siasat juga tidak menunjukkan bahawa Teoh dipukul atau diseksa sebelum ditemui mati.

Daripada kecederaan yang beliau alami, tidak ada bukti keterangan forensik untuk menyokong mengenai dakwaan (dipukul atau diseksa), katanya ketika menyambung semula keterangannya semalam selepas ditangguhkan hujung tahun lalu kerana gagal hadir selepas mendakwa menerima ancaman keselamatan.

Dalam keterangannya tahun lalu, Pornthip berkata, beliau berpendapat 80 peratus punca kematian akibat dicekik dan didera, manakala 20 peratus lagi bunuh diri sehingga mahkamah membenarkan mayat Teoh digali untuk dibedah siasat kali kedua.

Disoal peguam pemerhati Kerajaan Selangor, Malik Imtiaz Sarwar berhubung anggaran peratusan itu, Dr Pornthip menukar pandangannya dengan tidak mengekalkan pendapat Teoh mati akibat dibunuh.

Selepas bedah siasat kedua, saya tidak dapat mengekalkan peratusan itu. Lebih-lebih lagi, saya sendiri tidak berada di tempat kejadian (ketika penemuan mayat Teoh) dan hanya menganggarkannya berdasarkan penemuan pakar patologi forensik serta gambar yang dirakam.

Ketika membuat anggaran itu sebelum ini, saya perlu meyakinkan Koroner untuk membenarkan bedah siasat kedua dijalankan. Bagaimanapun, saya masih mengekalkan pendapat si mati mengalami kecederaan sebelum jatuh dan berada dalam keadaan tidak sedar ketika jatuh, katanya.

Dr Pornthip juga berkata, kesan lebam pada leher Teoh bukan akibat dijerut atau dicekik, sebaliknya berlaku sebelum dia jatuh yang mungkin disebabkan hentakan kuat objek tumpul.

Katanya, ia juga mungkin disebabkan seseorang meletakkan sesuatu pada leher Teoh atau menekan kepalanya ke atas sesuatu.

Disoal peguam pemerhati keluarga Teoh, Gobind Singh Deo, Dr Pornthip berkata berdasarkan pengalaman siasatan di lokasi kejadian jenayah dan ahli sains forensik, sebarang nota yang ditemui mesti diuji untuk DNA, cap jari dan cap telapak tangan dengan segera dan dihantar untuk ujian analisis tulisan kerana ia adalah protokol.

Katanya, nota sedemikian tidak memberi kesan terhadap siasatan kerana ia dianggap bersifat emosi dan beliau lebih gemar bergantung kepada bukti lebih saintifik. Dr Pornthip selesai memberikan keterangannya semalam dan terus kembali ke negaranya selepas itu.

INKUES TEOH : BUKAN BUNUH DIRI ULANG PORNTHIP - malaysiakini

Ahli patologi forensik Thailand, Dr Pornthip Rojanasunand mula memberi keterangan di bangunan mahkamah di Shah Alam, jam 9.31 pagi bagi menyambung keterangan inkues kematian Teoh Beng Hock.

Ia merupakan sambungan kepada keterangan yang diberikannya hujung tahun lalu, yang tidak dapat diteruskannya ketika itu apabila beliau tidak hadir di Mahkamah Koroner, dikatakan berikutan terdapat ancaman terhadap keselamatan dirinya.

Pada keterangannya tahun lalu, Pornthip menyuarakan pendapat terdapat 80 peratus kemungkinan bahawa Teoh mati akibat dicekik dan didera, dan mahkamah kemudiannya membenarkan mayat Teoh dibedah siasat kali kedua oleh Ketua Unit Patologi Hospital Sungai Buloh, Dr Shahidan Md Nor, pada 22 November lalu.

Teoh, 30, setiausaha politikkepada Exco kerajaan negeri Selangor, Ean Yong Hian Wah ditemui mati pada 16 Julai tahun lalu di tingkat lima, Plaza Masalam selepas memberi keterangan di pejabat Suruhanjaya Pencegahan RasuahMalaysia (SPRM) Selangor yang terletak di tingkat 14 bangunan sama.

Pornthip, sebelum ini menimbulkan kontroversi dengan mendakwa hasil pemerhatiannya mendapati kemungkinan 80 peratus kematian Teoh adalah kerana dibunuh manakala 20 peratus lagi akibat bunuh diri.

Kehadirannya di mahkamah pagi ini disambut tepukan gemuruh oleh penyokong Teoh yang memenuhi bilik perbicaraan hari ini.

Let’s wait and see what action will be taken against Siti Inshah Mansor, the principal of Sekolah Menengah Kebangsaan Tunku Abdul Rahman Putra, Kulai, for the racist remarks she allegedly made at the Merdeka celebrations in her school.

The police will be concluding their investigations soon, under Section 504 of the Penal Code. If they have a case, Siti Inshah could be charged with provocation, which carries a maximum imprisonment of two years, a fine or both.

Meanwhile, DAP supremo Lim Kit Siang has called for her to be sacked. MCA president Chua Soi Lek calls for her to be transferred to a desk job and given counselling. How generous of Chua.

Of course, I’m being facetious, but this must surely be the fantasy of anyone who feels disgusted by any racist act. All the more so if it is committed by someone who is a principal of a school, who should be spreading the message of racial unity instead of – God forbid! – racial hatred.

Siti Inshah is alleged to have said that Chinese students are not needed in the school and can go back to China or Sekolah Foon Yew (a private Chinese school in Johor), and that the prayer strings Indian students wear on their neck and wrist make them look like dogs, and only dogs would be tied this way.

If the allegation is true, what could have possessed her to make her say such things? That is something that must be ascertained. Even if she had been provoked for some reason or other, it is still not her place to react this way to the students. She has a huge responsibility as a school principal to restrain her racist impulses.

Given the seriousness of the situation, if the allegation is true, how then can she be allowed to get away with it? If she were to be exonerated, imagine the damage she could further cause given her influential position.

If it is true that she behaved like a racist, her name should instead be remembered in the Hall of Shame.

So far, however, among the Barisan Nasional parties, only the MCA and the MIC have criticised the action. Has any Umno leader come out to say anything against it? And if so, why not?


If the people who are in charge of administering it are not up to it, if instead they are exposing the wound to even more bacteria, then we should be looking for an alternative cure.


Siti Inshah is also alleged to have called her non-Malay students penumpang (passengers or tenants) in this country. First, we had Umno politician Ahmad Ismail calling non-Malays pendatang, now there’s penumpang. What will they think up next?


These racial slurs are getting out of hand. And that’s worrisome. It’s symptomatic of the times. We are getting more divided along racial lines than perhaps ever before.

That’s what you get when you allow the mainstream newspapers to go to town scaring the Malays into believing that the non-Malays are a threat and will soon take over the country.

When someone like Zaini Hassan can write irresponsibly and mischievously in Utusan Malaysia about a “large-scale war” breaking out that will be bigger than that of May 13, about an alternative constitution being written that will abolish the special position of the Malays and Islam. What rubbish!

That’s what you get when you allow newspapers and individuals to go around telling non-Malays they must be submissive, grateful and not speak up for their rights, or go home – to China or India.

That’s what you get when you allow organisations like Persatuan Pribumi Perkasa Malaysia (Perkasa) to go on their high horse and slam every reasoned argument made against their credo. So now, for every little thing they don’t like, they run to the police station to make a report.

That’s what you get when you give them so much face, to the extent of granting them a publishing permit virtually overnight; when you cut them so much slack by saying nothing when they challenge government policies that seek to address the nation’s fall from economic competitiveness.

And then no less than the Deputy Prime Minister invokes the ghost of May 13, pulling the perennial Umno stunt, to tick off Chua Soi Lek for asking for more non-Malay participation in the economy.

Not only is Muhyiddin Yassin behind the times in that regard; he actually warns that this could anger the Malays and it could amount to a spark similar to that which set off May 13.


Who is stoking the racial fire here? If a personage like the DPM says it will make the Malays angry, some people might be bound to take that seriously and really feel angered. If the DPM mentions May 13, that might put ideas in some fanatics’ heads.

Why must Muhyiddin say something potentially flammable like this?

As the nation’s No 2 leader, he should instead avoid bringing up such a thing instead of brandishing it like a Damoclean sword.
But then, that’s what constitutes the central problem of this country. Politicians will make capital of anything without thinking of its consequences. They are short-term players looking for short-term gains. And this short-term playing has been extended for decades in the sick politicisation of race.


Do we have to keep reminding them of the dangers of this game and still see nothing done about it even when the cows have come home? By then, it will be too late. The wound caused by racial discord might have become so infected that it can no longer heal.

The treatment has to start now.

And if the people who are in charge of administering it are not up to it, if instead they are exposing the wound to even more bacteria, then we should be looking for an alternative cure.

The inquest into the death of Teoh Beng Hock has been totally discredited.

Nobody is going to believe the coroner's verdict.

The latest sham that has emerged - claiming the discovery of a mysterious note - only seems to suggest what that verdict is likely to be.


We were told that the findings of the Teoh Beng Hock's death would be made known within two months.

Now after more than one year, we are nowhere nearer the truth;
no one is any wiser when the findings would be concluded.



All that we have witnessed are delays and denials adding to the agony
and anguish to the Teoh family.


It is unfair to them that they should suffer this dereliction without any sign of closure to this tragedy.

When one is seeking the truth, no stone should be left unturned; no scrap of evidence should be overlooked. But -- unfortunately -- this wasn't the case in this inquiry.

According to the investigating officer, he found a note in Beng Hock's sling bag but put it aside because he "did not realise the significance of it".

What gave him that right to come to this conclusion? His duty and business should have been to sieve through every item that was in that sling bag for possible clues. But he behaved like a clueless amateur displaying a total lack of discernment.

The Attorney-General's clarification - that when this note was finally
brought to his attention on 7 October 2009, he wanted further
investigations to be carried out - is indeed baffling.


He should have tendered this to the coroner for the court to determine its authenticity and relevance to the case. To submit this so-called "new evidence" some 10 months later is totally unacceptable. It only raises questions of ethics and propriety.


From whatever angle one may look at this situation, there is only one inevitable conclusion and that is evidence has been clearly and surreptitiously suppressed.


Instead of assisting by all means to arrive at the truth, the AG's Chambers have not acted in a transparent and honest manner by hanging on to this so-called "new evidence" that suddenly seem to have assumed "significance" now.


This so-called "new evidence" has unfairly disrupted the entire process/proceedings so far and made the inquiry untenable.

If it had been tendered from the very beginning, the trend of questioning would have taken a different form and direction.

There seems to be a contradiction in the statement issued by the AG's Chambers as to when the note was discovered.

In Paragraph 4, it is stated, "According to the investigation officer, it was not found when he first searched the deceased's sling bag after the incident." But in Paragraph 10, we are told: "However, recently the investigation officer owned up by admitting that he did in fact find the note when he searched the sling bag on July 17..." What then is the truth?

In Aliran's view, the inquest has been totally discredited and therefore
should be disbanded/discontinued;

it should make way for the setting up of a Royal Commission of Inquiry.

Anything short of this would be a travesty of justice.

Every time I go on the Net to see what is going on in KL -without fail – I will come across this Mahathir’s name!

An article about him, an article by him, something he said, something he did not say, and something he was going to say.

Why has not this Mahathir got the grace to understand that he is no longer P Minister?......sorry that should have been Prime Minister!

This Mahathir must really have a thick skin.

Anybody else would have just crawled into a dark hole somewhere and hide.

Tak malu ka?

How much more money do you want? Pension not enough?

Your children not giving you enough pocket money? Isn’t Petronas paying for the petrol you use?

I do not want to demonise you but really Tun enough is enough!

In your good old days people like Ibrahim Ali would not even get through your first layer of Setia Usahas. And yet these days you are the best of buddies.


For the love of God, Tun jaga standard sikit lah! Even your children will not be seen dead with this Ibrahim Ali…jatuh standard lah Tun!

Just stop to think what it is that you are doing. I am not going to go into nepotism, money politics or abuse of power – I am just trying to understand how a person that considers himself to be the greatest PM Malaysia has ever had can now do what you do.


And what you do is to bring yourself down to a level where people like me – an old man in Adelaide – can have you in my sight and fire away at you.

Call you whatever name I want, expose whatever wrong doings you have done while in office and do so without any qualms.


I do not do so with Daim..nor with Lim Chong Eu…nor with Pak Lah…you are fair game because you put yourself right square in our sights.

And if you think you do so because you can take anything that we throw at you and give back as good as you get…think of this:

A democratic victory for the people is when BN is faced with the real possibility of losing a General Election.

And that Tun has already happened under your watch – under the people you picked and choose as your team, as your people as your successor. So it has already happened and you Tun made it happen.

All your choices of people to manage UMNO during or after your time were failures. And it all comes back to you. That you have already bankrupted Malaysia is a given fact.

That you have caused untold misery and hardship for so many people by your
non- judicious use of the ISA is also a given fact. That the IPP’s agreements, the Tolls Agreements, the Privatisation process – and so many other initiatives undertaken under your watch are greatly flawed and lopsided in favour of your chosen cohorts and friends is also a given fact.



So what is left Tun?

You are trying to right a wrong? Trying to correct a mistake. Trying to make up for the mistakes you have done? Trying to make back for our country all the monies you have given away or lost through your time as Prime Minister?


Let me tell you this TUN – there will not be enough time to do that even if your grandchildren were to start now to do so. The damage done to our economy, the losses sustained by the country and the restructuring you did of the various races in the country people cannot be corrected within our lifetime – or that of our children.

As for UMNO: it is done Tun. Common sense tells me that you would never have chosen Najib as Prime Minister.

Why? He has no balls. No substance. No guts.

He is not PM material and you are practical enough not to pick him even if he did deliver the decisive support you needed in your fight against Musa and Ku Li.

No Najib will never be you choice. Nor , now it seems was Pak Lah. So who? Your son….please don’t play play lah!


And so now you are watching the closure of UMNO in the history of our country.

Please God - give you long life so that you will see a PR government take office at Putrajaya and a PR Perdana Menteri move into Sri Perdana…because TUN, that will be the deepest cut of them all...for all the sins you hv done to Msia...!

Pada pagi 10 Ogos 2010, di perkarangan mahkamah, pemberita Berita Harian menyatakan beliau di arahkan menanyakan soalan mengenai tuduhan Ezam Mohd Nor mendakwa kononnya saya telah menelefon beliau mengarahkan supaya menghalang lelaki mendekati Saudara Anwar. Saya dengan tegas menafikan tohmahan jahat beliau. Ezam sengaja mereka cerita setelah beliau bersama UMNO dan tidak sebelumnya.

Saya tidak pernah menelefon beliau mengaitkan Saudara Anwar seperti tohmahan tersebut. Saya kesal kerana nafsu politik beliau tidak ada batas; sehingga sanggup memfitnah saya selaku isteri dan ibu. Ternyata untuk kekal relevan sebagai alat pimpinan UMNO, kerja beliau hanya mencerca kami.

Saya telah enggan melayan sebarang kenyataan beliau yang di buat hasil menerima upah pimpinan UMNO, walaubagaimanapun kerana tuduhan tersebut berulang dan mengaitkan nama saya secara peribadi, saya mengingatkan beliau supaya hentikan kerja fitnah yang jelas fasiq.

Sekira beliau mengulangi fitnah tersebut, saya akan mengambil tindakan undang-undang terhadap beliau dan merujuk beliau ke Mahkamah dan Mahkamah Syariah.

还有王法?法律公正在那里???之前,搞直销骗钱捞钱事件还没查完,...国贸合作社部门还在查...,如今是"王上王",拿刀斩人当饭吃,"扑街王"????????我们要IGP解释???

司法不昭,那就替天行道吧
就像政府不公,咱們得換掉他。

就像公務員不貞,胡亂收禮/送禮,把國家的財富當人情,咱們得記恨他,下屆掃掉他一般,用商业制裁来对付这种黑店,使它自然灭亡,莫要再害人害己是最好的。

华联花园Steven’s Corner 就在我们的货舱隔壁。

每天傍晚开始,他们就会把三张桌子和多张椅子排在我们货舱门口。之前我们已经告诉他们说,我们还没关店,你们这样摆放桌椅,会妨碍我们上下货。。可是,每天他们还是老样子。。有时我们要移开那些桌椅还得“请示”他们呢!


昨晚大概八点左右,我的家公就像平时一样到货舱拿货。同样的,货舱门口已经排满了桌椅,而且还坐着人。于是家公就叫那些人换去别张桌子,移开桌椅后,他才可以拿货。

怎知这时,Steven’s Corner 的大老板走过来直接...审问家公为何他搬开那些桌椅。还没来得及反应,三拳已经挥打过来了!在场的工人看到这样的情形就马上跑回店通知序杰和小叔。。

当序杰和弟弟到场,看到家公跌倒在地上。。



试问一个六十多岁的老人家怎样顶得住?那个恶人看到他们兄弟俩来了还挥刀讲要砍死他们呢!Steven’s Corner 的一大班员工拉着他们的老板才不致于搞出人命!当时还有一个四眼的华人赶到说:“这个场我看的,你们在这里做什么?”

哈哈!你们相信吗?mamak 店都有人看场啊!

那个大老板恶人还恐吓我们,如果我们叫警察,他们也不会怕,但是我们就得小心出入,并不排除会放火烧店!这样还成世界吗?这条路已经变成Jalan Steven’s Corner了!






不久,警察和YB郭素沁来了解情形。YB了解了事情的来龙去脉,家公被送到马大医院验伤,打人者,则被送到警局扣留。YB交代手下帮忙后她就去开会了。现场的警察听说可能有记者到访,就在等。。要不然,早就离开了。。如果没有YB在场,我相信那个恶人也不会被送到警局!

Steven’s Corner的店有安装CCTV,只要警察开来看,一定可以看到整个案发过程,只是看他们要不要而已!

另一方面,家公大概九点多到马大医院,可是还得折腾到整一点钟才验完伤!(我加的這句:真是好料的尿部長!)不得不佩服我们的医院办事效率!

验完伤后,就赶到警局报案。一进到警局,就看到那个四眼看场在那里等了。当时,我真的感到高兴,因为,我真的以为恶人被拘留了。。我们还发现,原来四眼看场跟警察还蛮熟的呢!他们可以坐在花园的椅子聊个不停。。



当家公在录口供时,我们到处张望。。不得了!我们在警察的偏厅发现那个恶人!不是说被“Lokap”了吗?为什么他可以完整无恙的坐在那里?那个偏厅有冷气,电视机,sofa。。他还可以自由的打电话呢!这是什么世界?

录完口供后,警察叫我的家公进去偏厅。。还以为什么事。。原来,我们正义的警察尽然叫我那年迈被打的家公和那个恶人和解!天啊!难道真的是有钱就大完吗?没有天理了吗?被打的人还要当做没事发生?我的家公没有考虑就直接走了出来。。


今天早上,YB郭素沁安排了一个记者发布会,希望当局会正视这件事,也希望给我们一个公道,更希望这样可以阻止恶人继续恶行下去!

我的家公在华联花园可是有名望的人士呢!他不但是育南华小的董事,陶瓷行的老板,更是很多社会团体的佼佼者!(又是我加的:這個根本不重要啦,就算是阿貓阿狗無辜被打也是可以討公道的,不是說有名望的人就更加一定要討公道什麼的。。。)

希望大家一起boycott Steven’s Corner!!!(又又是我加的:馬打tak boleh harap的話我們也不可以坐以待斃,我們也有替天行道的本錢──杯葛他。像這類店讓他自然死亡是最好不過的,大家不要去消費,他做不下去了就沒有錢拿來疏通了,也算是為社會除害。。。阿彌陀佛,功德無量呀。)

50 years of ISA – Enough is enough!

This is our 53rd year of independence. But for 50 years, that independence has been marred and rendered meaningless by the continued existence of the ISA. It has been used and abused to silence critics and put away dissidents. It is an instrument that threatens our freedom and our civil liberties. It creates a climate of fear.

That is why the indomitable D R Seenivasagam called the ISA “a vicious and repulsive document, a document which is repulsive to all those who believe in democracy.”

He found it “difficult to believe any citizen of this country could have drafted this Bill if he has the interests of his fellow citizens at heart”.

He was right there. The ISA did not serve the interests of the citizens; it only served the interests of those in power.

Under the guise of national security, the ISA has been turned into a political tool to serve the ruling elite to remain in power. Any time and every time the Barisan Nasional was in a fix, it resorted to the ISA to safeguard and entrench its position.

Some 10,000 innocent people have fallen prey to this obnoxious legislation. Without any justification, they have been detained unfairly and unjustly.

Not a single one of them has been charged or convicted in a court of law. They were not brought to court simply because the government had no specific and legitimate charges against them, and their flimsy reasons for detaining them would not have stood up in a court of law.

That is why the court’s jurisdiction to review or challenge their detention has been ousted. The Minister’s decision cannot be challenged in any court of law.

The Minister’s decision is final. End of the matter. That is wrong.

And the Minister has that absolute undemocratic right to extend a detainee’s detention every two years indefinitely. That is wrong.

The detainee can periodically appear before the Advisory Board to state his or her case. Very often it is a waste of time. The Advisory Board that hears a detainee’s representation can only make recommendations to the Home Minister which he usually brushes aside. That is wrong.

Friends: It is a mockery to have a law that does not provide for your defence in a court of law in keeping with natural justice.

It is a mockery to the rule of law when a detained person has no legal access to a lawyer.

It is a mockery to our democratic system when a person can be held in solitary confinement for up to 60 days without family visitation rights whatsoever.

It is a mockery to us as human beings that this terrible law has been allowed to be around for half a century.

Friend, don’t waste your time asking for the repeal of the ISA. It won’t happen. It is the armour that protects the BN. The BN will never throw away this protective shield. The BN will not repeal the ISA. Let’s accept that as a fact.

The only way to remove the ISA is to remove the BN from power. The moment you remove the BN, the ISA will disappear. As long as the BN exists, the ISA will exist.

We should target the BN and channel our energies for the defeat of the BN. When the BN becomes the Opposition in Malaysia, that day will spell the end of the ISA.

Our slogan should be “Remove the BN” – not “Repeal the ISA”.

Subject: *Mesti Baca- Retorika Palsu mengenai Hak Melayu

Apakah yang dimaksudkan dengan “hak-hak Melayu” dan dimana termaktubnya hak-hak ini? Adakah ianya adil dan sah sekiranya sesuatu kaum mengapropriasi “hak” yang melebihi daripada apa yang diperuntukan dalam Perlembagaan?

Baru-baru ini, terdapat cadangan untuk memansuhkan diskaun bumiputera bagi hartanah mewah. Dan seperti biasa, hero-hero Melayu akan menggoncang pedang dan menghentakkan kaki kerana kononnya “hak-hak istimewa” Melayu telah sekali lagi tergugat.

Saya faham politik. Politik adalah seni membohong dan menipu, seni mengkritik dan menepis kritikan. Apa yang ahli politik luahkan adalah tidak lebih dari retorik dan janji-janji manis, yang menjadi topeng kepada agenda tersendiri ahli politik tersebut. Tetapi apa yang saya tidak boleh terima adalah politik perkauman, lebih-lebih lagi yang jauh terpesong daripada kedudukan sebenar. Maka apabila ahli politik atau hero-hero ini berdegar-degar bercerita tentang “hak-hak Melayu,” saya rasa terpanggil untuk menjawab.

Retorik “hak Melayu” ini semakin menjadi-jadi sejak akhir ini. Malahan, jika diteliti, ia mula mendapat sambutan sejak pilihanraya umum 2008. Sesetengah pihak, dalam usaha mereka untuk terus menjadi releven, telah memilih untuk menggunakan retorik ini sebagai bahan politik mereka. Selalunya ahli politik sedemikian adalah ahli politik picisan yang tidak mempunyai nilai-nilai yang mencukupi untuk mengangkat mereka daripada gred C atau B kepada gred A. Dengan memainkan isu seperti yang penuh emosi seperti ini, mereka akan lebih mudah mendapat sambutan.

Dikatakan bahawa hak orang Melayu kian terhakis. Tergugat. Cauvanis Cina sedang bersengkol dengan agen asing untuk menawan negara dan menjadikan Malaysia sebagai Singapura. Orang Melayu perlu bersatu untuk menghadapi ancaman ini. Orang Melayu perlu bersatu untuk “mempertahankan hak-hak Melayu.”

Tetapi apa itu “hak-hak Melayu”? Rakyat semakin cerdik. Meraka mahukan dalil jika berhujah tentang sesuatu perkara. Tidak cukup untuk berkata bahawa “Melayu ada hak.” Orang akan bertanya, di mana datangnya hak itu? Untuk memberi legitimasi kepada hujah mereka, pelopor retorik ini mencekup “dalil” mereka daripada Perlembagaan Persekutuan.

“Hak-hak Melayu seperti yang dijamin di bawah Perlembagaan Persekutuan!” jerit mereka. Perkara 153 Perlembagaan Persekutuan menjadi peruntukan keramat kepada mereka. Ia menjadi selimut luas yang melingkupi segala apa yang mereka katakan sebagai “hak Melayu.”

Malangnya, rakyat masih belum celik Perlembagaan. Rakyat mungkin mahukan dalil, tetapi masih tidak menyemak samada dalil yang disajikan adalah benar. Apabila ahli-ahli politik ini menggunakan Perkara 153 sebagai dalil mereka, ramai yang percaya. Lagipun, sudah terbukti bahawa sekiranya sesuatu perkara itu diulang berkali-kali, orang ramai akan mempercayainya lama kelamaan. Propaganda 101.

Saya tidak ingin menyelami Perkara 153 di sini. Saya percaya ramai komentar dan penulis di luar sana yang telahpun menukil rencana tentang peruntukan ini. Cukuplah di sini bahawa Perkara 153 memperuntukan tentang kedudukan istimewa orang Melayu dan pribumi Sabah dan Sarawak dalam perizaban quota dalam beberapa perkara seperti perkhidmatan awam, lesen dan biasiswa.


Perkara 153 ini tidak boleh dimansuhkan atau dipinda dengan sewenang-wenangnya oleh Parlimen dan perlu persetujuan daripada Majlis Raja-Raja. Maka momok bahawa Perkara 153 ini adalah dalam bahaya jika Melayu tidak bersatu adalah tidak lebih daripada bohong yang dicanang oleh sesetengah pihak.

Lebih penting lagi, kita harus membezakan di antara Dasar Ekonomi Baru (DEB, atau NEP dalam bahasa Inggeris) dan Perkara 153.

Ramai orang telah keliru atau sengaja mengelirukan antara keduanya, walhal satu hanyalah dasar nasional dan satu lagi adalah peruntukan Perlembagaan. Menukar, memansuhkan atau meminda DEB tidak bermakna mencabar Perlembagaan.

Berbalik kepada pemansuhan diskaun kepada bumiputera dalam pembelian rumah. Banyak pihak berhiruk dan berpikuk yang kononnya ini adalah salah satu daripada “hak istimewa orang Melayu” yang “tidak harus dicabar.”

Tetapi adalah terang lagi bersuluh bahawa diskaun ini adalah dasar yang diperkenalkan oleh DEB dan tidak ada kena-mengena dengan Perkara 153. Tidak langsung terlakar dalam Perlembagaan bahawa orang Melayu berhak mendapat diskaun dalam membeli rumah.


Samalah juga pemberian tender kepada kontraktor Melayu bukanlah sesuatu peruntukan Perlembagaan yang menjadi hak tetapi sesuatu dasar di bawah semangat DEB.

Dan walaupun Perkara 153 mempunyai peruntukan tentang perizaban kuota dalam biasiswa dan pendidikan, ia tidak pula menyatakan bahawa mana-mana universiti atau kolej hanya boleh membawa masuk pelajar bumiputera.

Hujah sesetengah pihak bahawa universiti tertentu adalah “benteng terakhir” kaum bumiputera tidak boleh dipertahankan dengan merujuk kepada Perlembagaan.

Inilah masalahnya. “Hak Melayu” telah dipesongkan untuk meliputi pelbagai perkara yang langsung tidak berlandaskan Perlembagaan. Ada ahli politik, dalam membantah pemilihan hakim-hakim melalui suruhanjaya, berhujah bahawa ini akan membolehkan seorang bukan Melayu untuk menjadi Ketua Hakim Negara.

Ada pula ahli politik yang berkata bahawa pemindahan kuil Hindu kepada kawasan majoriti Melayu adalah bertentangan dengan Perlembagaan. Bahkan, ada juga mengatakan bahawa kritikan terhadap Polis Diraja Malaysia (PDRM) dan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) adalah serangan ke atas “institusi-institusi Melayu.”

Sejak bila pula perlantikan Ketua Hakim Negara, penentuan tempat-tempat ibadat dan PDRM menjadi sebahagian daripada “hak-hak Melayu” yang terkandung di dalam Perlembagaan? Dan jika Perlembagaan tidak mempertukannya, dari mana pula datangnya apa yang disebut sebagai “hak”?

Secara dasarnya, saya tidak mempunyai masalah dengan usaha memartabatkan orang Melayu. Tidak salah sekiranya bantuan diberikan kepada orang Melayu yang memerlukannya.

Sekiranya tidak bersetuju dengan pemansuhan diskaun bagi rumah mewah, berikan alasan mengapa tidak bersetuju secara rasional dan telus. Jangan bersandarkan retorik “hak Melayu” yang tidak mempunyai asas. Jangan membakar sentimen perkauman demi agenda politik yang sempit.

Perlembagaan kita telah mencapai keseimbangan di antara kepentingan pelbagai kaum di dalam negara ini. Oleh itu, tidak adil dan tidak sah sekiranya sesuatu kaum mengapropriasi “hak” yang melebihi daripada apa yang diperuntukan dalam Perlembagaan.

Sudah tiba masanya kita, sebagai rakyat biasa, mencelikkan mata kita kepada Perlembagaan. Kita harus memperkukuhkan diri kita dengan konsep keperlembagaan, tentang hak dan tanggungjawab.

Kita tidak boleh biarkan ahli politik dan pihak-pihak berkepentingan untuk memperalatkan kita, melaga-lagakan kita dan memperbodohkan kita dengan omong-omong dusta. Hanya apabila kita mempunyai pemahaman barulah kita boleh bezakan yang hak dan yang batil.
